Every big Bollywood split comes with a number attached. Most of those numbers are reported by unnamed sources and never confirmed by either party. What is worth understanding is the process, because that part is public record and it explains why some divorces take three months and others take six years.

Mutual consent is the fast lane

Under Indian law, a couple that agrees on the terms can file jointly for divorce by mutual consent. There is a statutory waiting period between the two motions, though courts have discretion to waive it where a settlement is already agreed. This is why the celebrity divorces that seem to happen quietly and quickly are almost always mutual-consent filings — the terms were negotiated long before anything reached a courtroom.

    Contested cases take years

When one side does not agree, the case moves through evidence, cross-examination and appeals. Property valuation and child custody are the two things that stretch timelines the most.

    What a settlement usually covers

    • Maintenance or alimony — either a one-time lump sum or a monthly figure. Lump sums are more common in high-net-worth settlements because they end the relationship cleanly.
    • Child custody and support — increasingly joint custody in high-profile cases, with one parent as primary carer.
    • Property division — India has no automatic community-of-property rule, so this depends heavily on whose name assets sit in.
    • Confidentiality — the reason so many reported figures are never confirmed.

Why the reported numbers are usually unreliable

Settlement terms in mutual-consent divorces are typically not published. When a figure appears in the press with no filing to back it, treat it as a claim, not a fact. Courts do not issue press releases about alimony, and both parties usually have every incentive to stay quiet.

    Quick answers

    Is alimony mandatory in India?

No. Maintenance is decided case by case based on income, standard of living during the marriage, and the needs of each party. A financially independent spouse may receive nothing.

    Can both partners waive alimony?

Yes. In mutual-consent divorces, either party can agree to waive maintenance as part of the settlement.

    Who gets custody?

Courts decide on the welfare of the child, not on the parents claims. Joint custody arrangements have become far more common.
